The 2023 Legislature was a landmark session for LGBTQ+ bills, according to advocates.
Marshall Martinez, executive director of Equality New Mexico, said three bills passed in the 2023 Legislature that make this past session a watershed moment for the LGBTQ+ community, creating a more equitable landscape.
EXPAND HUMAN RIGHTS ACT SCOPE (New Mexico bill HB207) aims to expand the scope of the New Mexico Human Rights Act to include protections for the LGBTQ+ community. The bill passed the House by 47-to-20 votes. The bill would apply to certain actions of the state and its political subdivisions and public contractors, expanding the rights act. New Mexico already provides benefits to same-sex partners of state employees, and same-sex marriage is legal statewide since December 2013.
NO PUBLICATION REQUIRED FOR NAME CHANGES (New Mexico Bill HB31) removes the requirement for a notice of legal name changes to be published in a newspaper, providing privacy and safety for New Mexicans seeking a name change.
REPRODUCTIVE & GENDER-AFFIRMING HEALTH CARE FREEDOM ACT
(New Mexico bill HB7) prohibits public bodies from restricting access to abortion and gender-affirming health care. It codifies the protections outlined in Governor Lujan Grisham's August 2022 executive order, including prohibiting entities within the state from sharing patient information related to reproductive health care for New Mexico patients and providers. The bill is a significant step towards safeguarding reproductive and gender-affirming healthcare in New Mexico and protecting the rights of patients and providers.
